Contact and residence arrangements
A workable arrangement needs to fit the child's circumstances, including school, routine, relationships and any additional support needs. Some parents can settle the detail through discussion. Others need a court decision about contact, residence or a specific issue.
We can help you prepare for negotiation, set out proposals clearly and understand what a court will need to consider. We also advise on existing orders when circumstances change or an order is not being followed.
The child's welfare and views
Section 11 of the Children (Scotland) Act 1995 provides for orders relating to parental responsibilities and rights. The child's welfare is central. Their views also matter, with the appropriate way and time to obtain them depending on the child and the stage of proceedings.
An urgent interim hearing can address a short-term problem before the court has all the information needed for a lasting decision. We help you distinguish what must be sought immediately from what needs fuller evidence and consideration.
A result that can last
Court orders and agreements need to work after the hearing is over. We look beyond the immediate dispute to the handovers, holidays, communication and other details that can prevent a new disagreement.
If you are considering an appeal against an interim decision, it is especially important to identify the error alleged, the remedy an appeal could provide and whether the live issue can be addressed sooner in the sheriff court.
