Separation Agreements in Scotland

A separation agreement can give both parties clarity about the terms they have reached. Before signing, each person should understand what the agreement covers, what information it relies on and how its terms will operate in practice.

Recording an agreement clearly

An agreement may deal with the family home, savings, debts, pensions or other financial issues arising from separation. The correct scope depends on what has been resolved and what remains open. Clear drafting helps avoid a fresh dispute over what the parties intended.

We can help negotiate terms, prepare a written agreement or review a draft supplied by the other party. We will explain the effect of the proposed wording and flag information still needed before you decide whether to sign.

Independent advice and disclosure

It is useful to know what assets and liabilities exist and how they have been valued. An agreement reached without adequate information or under pressure may lead to further conflict. Taking advice before signing gives you a chance to test the proposed terms against your actual circumstances.

If you already signed an agreement and now have concerns, bring the document and the surrounding correspondence. Whether terms can be challenged depends on the facts and the applicable legal tests; an unfavourable result alone does not settle the question.

A practical route to resolution

A well-considered agreement can reduce uncertainty and help avoid unnecessary court proceedings. We focus on both the legal wording and the practical steps needed to put it into effect.

Where negotiation is still in progress, we can help identify the points that matter most, make proportionate proposals and decide what to do if agreement cannot be reached.
